Abstract
This Law establishes that the use of protected species must not threaten the long-term survival of such species and efforts to ensure a favorable conservation status. Persons using protected species must comply with the requirements of this Law, the Law on Wild Animals, the Law on Wild Plants and Mushrooms, the description of the procedure for the use of protected species approved by the Minister of the Environment, and the rules for trade in wild animals, plants and mushrooms. Removal protected species from the natural environment, observing, marking, filming, photographing, breeding, keeping them in captivity, using protected species for scientific research and other forms of use, except for the trade of animals, plants and mushrooms of protected species, is carried out in accordance with the Protected Species Act approved by the Minister of the Environment description of the procedure for use. A permit to observe, film and photograph protected species is not required when these species are not disturbed, except for: (a) protected animal species entered in the list of protected animal, plant, and mushroom species of the Republic of Lithuania and the lists of animal and plant species of importance to the European Community; (b) during breeding at the habitats of animals of protected species; and (c) animals of protected species in their wintering grounds during hibernation. Trade, offer for sale or purchase, import, export, re-export of animals, plants and mushrooms of protected species is permitted in accordance with this Law, the Law on Wildlife and the Rules of Trade in Wild Animals, Plants and Mushrooms. This Law establishes the procedure for issuance or refusal of issuance of permits for import and export of protected species. The validity period of the permit to import into or export of wild plants and/or mushrooms of protected species is determined with the consideration of the expected date of import (export), but no longer than 6 months from the date of of issuance of permit to import or export protected species.
