Abstract
This Law establishes and regulates relations pertaining to the protection of location sites and habitat sites of protected species and communities of fauna, flora and funghi. Article 3 lists the principles of protection of protected species and communities including territorial protection and special projects to protect species that are in danger of becoming extinct. A list of rare fauna, flora and funghi shall be included in the Red Book of Lithuania which shall be comprised and administered by the Ministry of Environmental Protection (art. 4). There are extensive provisions relating to the regulation, control and trade of protected species and communities (Chapter III). The Ministry of Environmental Protection shall implement state control of protected species and communities (art. 16). The protection requirements of protected species and communities must correspond to the international agreements signed by the Republic of Lithuania. The following activities related to wild birds are prohibited: (a) intentionally kill or capture by any means; (b) intentionally destroy or damage nests and eggs of wild birds or destroy nests; (c) collect eggs of wild birds in nature, keep these eggs, even if they are empty; (d) intentionally disturb wild birds, especially during their transition and rearing of chicks, if such disturbance could have significance in the pursuit of ensuring a favorable conservation status of the respective species; (e) consider it prohibited to hunt and catch wild birds; and (f) sell, transport or store for the purpose of sale, offer for sale live or dead wild birds, their easily recognizable parts or products from them. The following activities shall be considered complying with acting legislation: (a) hunting wild birds using the authorized hunting gear and methods specified in the Hunting Law of the Republic of Lithuania, in compliance with the rules of Hunting in the territory of the Republic of Lithuania approved by the Minister of the Environment, which determine the species of wild birds authorized for hunting, hunting terms, methods and other conditions; (b) trade of wild birds, authorized by the Minister of Environment; and (c) movement of all or part of the material of a wild bird's nest to another place in the immediate environment or on an artificial nest site suitable for the respective species of wild birds installed in the immediate environment.
