Cabinet of Ministers Regulation No. 346 validating the Procedure for issuing permits for the use of land in coastal waters and on land for the construction of engineering structures of the first or second group intended for tourism and recreation.

The document sets out the legal framework for granting, suspending, or revoking permits to use areas in coastal marine waters and adjacent land for the construction of first- and second category engineering structures intended for tourism and recreational purposes. The Regulation applies both to structures built directly in near shore waters and to those connected to land as an extension of coastal development. The purpose is to ensure that such developments comply with construction, spatial planning, and environmental protection requirements.
Under the procedure, the municipality plays a central role. It first assesses whether proposed construction sites align with local development planning documents and objectives. The municipality must then obtain opinions from competent authorities, including institutions specified in marine protection legislation, the State Environmental Service, and the Nature Conservation Agency. Based on these opinions, the municipality decides whether to support the development proposal and organize an open competition for the right to use the relevant marine and land area, or to reject the proposal.
If a proposal is approved, the municipality grants the competition winner a permit to use the marine and land area for up to 30 years, including conditions on operation, maintenance, and dismantling after the activity ends. A lease agreement is concluded for the same duration as the permit. The permit may be suspended for up to 12 months or revoked entirely if the holder violates permit conditions or environmental and construction laws, or if their activities harm the marine environment, biodiversity, public beach access, or human safety and health, in which case the lease agreement is also terminated.
