Abstract
This Law consisting of 25 articles applies to the following lands (1) agricultural lands owned by the State or that will be transferred to State ownership in the future, except for lands managed by the Ministry of Agriculture and Agrarian Reform or other public bodies, and lands allocated by the State for non-agricultural investment purposes (2) wasteland and desert lands designated for rehabilitation, reconstruction, and distribution projects by a Council of Ministers' decision. The management, reclamation, and reconstruction of these lands shall be overseen by the Public Corporation for Agrarian Reform and Land Reconstruction. This corporation will also handle the distribution of lands, which will be governed by contracts detailing the distributor's obligations, including the price, payment conditions, and the organization's supervisory role. All distributed lands will be registered. Under Article 10, ownership of distributed land is not transferred until the full price is paid and the contract is registered, with recipients and their heirs unable to dispose of the land before full payment for up to fifteen years from distribution or until payment is complete, after which the land can only be expropriated for public benefit or to pay debts to the government, public institutions, or agricultural cooperatives. Article 4 specifies that the Council of Ministers will determine the agricultural lands eligible for distribution to farmers. This includes the size of the agricultural unit allocated to each farmer, the price to be paid to the State (in installments over a maximum period of 15 years), and the payment conditions. Article 7 stipulates that land allocation shall be granted to Libyan citizens who lack sufficient means for a decent living, provided they are engaged in agriculture or capable of performing agricultural activities. Among those who meet these criteria, priority will be given to individuals with larger families and fewer financial resources. By law, agricultural cooperative societies are formed from land recipients, and local farmers with land holdings up to the size of the distributed agricultural unit may join (Article 14). Under Article 20, by decision of the Minister of Agriculture and Agrarian Reform, Committees shall be established to address all objections submitted as appeals against decisions made under this Law. These include matters related to land distribution, lease contract termination, land recovery, compensation assessment, and other relevant issues.
