Abstract
This Law consisting of 60 articles organized into five Chapters aims to establish a Financial Supervision Authority. The Authority endeavors to exert efficient administrative oversight over state executive agencies, monitoring their activities to ensure fulfillment of responsibilities within their respective jurisdictions, adherence to laws and regulations, and dedication to citizen service among its staff. Furthermore, the Authority is committed to uncovering and addressing any crimes or violations related to official duties, upholding the integrity of public office. To fulfill these objectives, the Authority is empowered by this Law to exercise its jurisdiction over ministries, departments, local government units, Libyan diplomatic missions, public and private institutions, as well as entities with state involvement or oversight. The Authority will wield its powers by conducting essential investigations and routine inspections of supervised entities to ensure compliance with relevant legislation, oversee their performance, combat administrative negligence, address misconduct, identify and address crimes or violations by employees, and take necessary measures to control offenses affecting job duties, public service, or the public interest. Under article 29 the Authority must take the necessary procedures and measures to protect crime whistleblowers, witnesses, and experts from any attack that may occur against them due to their reporting, testimony, or experience. Furthemore, the Authority may, at any time, conduct a surprise inspection of entities subject to its supervision. A member of the Authority has the right to view all documents related to those entities, even if they are confidential, and to reserve whatever accounts, documents, records, or any other papers or documents he sees fit. Article 43 establishes a Disciplinary Council for Financial Violations empowerd to prosecute individuals, including employees and officials of supervised entities, for financial infractions against the State Financial System Law, as well as other financial violations outlined in relevant legislation governing supervised entities.
