Abstract
The Regulation on the Operation of the System for the Rapid Exchange of Information on Hazardous Products establishes procedures and mechanisms for the use of the system for the rapid exchange of information on hazardous products between market surveillance authorities regarding corrective measures taken in relation to non-food products that pose a serious risk to consumer health and safety, as well as the results regarding the implementation of follow-up actions in accordance with the information provided. The objectives of this Regulation are: (a) streamlining processes for notification mechanisms; (b) establishing notification criteria for notification mechanisms; (c) defining the content of notifications and follow-up notifications sent under notification mechanisms, particularly with regard to the required data and forms used; (d) establishing the actions to be taken by market surveillance authorities upon receipt of a notification and the type of information to be provided; (e) describing the procedure for processing notifications and follow-up notifications; (f) establishing timeframes for the various types of actions carried out under notification mechanisms; and (g) establishing practical and technical means for the effective use of notification mechanisms. Consumer commodities shall be considered products intended for consumers – products that are designed and manufactured for consumers and offered to consumers. This Regulation shall not be applicable to foodstuffs, animal feedstuffs and veterinary drugs. The data contained in the System for Rapid Exchange of Information on Dangerous Products contribute to: (a) preventing and restricting the supply of dangerous products; (b) monitoring the effectiveness and consistency of actions taken by market surveillance authorities and ensuring compliance with legislation; (c) promoting the consistent application of product safety requirements and thus the proper functioning of the internal market.
