Governmental Decree No. HG505/2020 validating the Regulation on export and import of hazardous chemicals.

This Regulation has the following objectives: (a) creation of a mechanism for the application of the Rotterdam Convention on the Procedure of prior informed consent for selected hazardous chemicals, hazardous substances and pesticides in international trade, to which the Republic of Moldova is a party; (b) establishing a procedure for export notification and obtaining preliminary informed consent for the export of hazardous chemical products that are prohibited or are subject to strict restrictions in the Republic of Moldova; (c) promoting collective responsibility and joint efforts in the field of international traffic in hazardous chemicals to protect human health and the environment from possible harm; and (d) correct, from an environmental point of view, use of hazardous chemical products. This Regulation ensures compliance with the classification provisions, packaging and labelling of chemical products hazardous to humans and/or the environment, when exporting and importing them, except in a situation where these provisions are contrary to any specific requirements of the respective parties or countries. This Regulation shall be applicable to: (a) hazardous chemical products that are the subject of the procedure 0f prior informed consent in accordance with the Convention, as per Annex No. 1; (b) hazardous chemical products that are prohibited or subject to strict restrictions according to Annex No. 1; and (c) exported and imported hazardous chemical products, in relation to their classification, packaging and labelling. Exporter who intends to export from the Republic of Moldova for the first time a chemical product specified in section 1 of Annex No. 1, to a party or another country, must notify the designated national authority no later than 35 days before planned export of a chemical product. The exporter then notifies the designated national authority for the first export of a chemical of this type, every calendar year, no later than 35 days before the date of export. The designated national authority receives guidance documents from the Secretariat on the decision on import of chemical products specified in section 3 of Annex No. 1. After approval or adoption of decision guidance documents from the Secretariat, the designated national authority informs the Secretariat of its decision on the future import of the chemical products in question within 9 months from the date of shipment by the Secretariat of the guidance document on decision-making.
