Governmental Decree No. HG538/2009 validating Sanitary Regulation on food additives.

This Governmental Decree shall be applicable to food additives placed on the market as food and presented as such, without prejudice to the provisions of the national legislation on novel food. Food additives are placed on the market only in the form packaged by the manufacturer. State supervision and control of food additives placed on the market shall be performed by the State Public Health Supervision Service. Import for the purpose of placement in free trade, storage for the purpose of sale or free distribution, placement in the trading network, sale or free distribution of food additives that do not meet the requirements of this Regulation. Food additives may be placed on the market of the Republic of Moldova only under condition of their compliance with the requirements of this Regulation. In the production of food additives shall be used only the following substances: (a) vitamins and minerals listed in Appendix No. 1 and in the forms listed in Annex No. 2 to this Regulation, under the conditions provided for in paragraphs 12-14 of this Regulation; (b) substances with a nutritional or physiological effect as defined in item b) of paragraph 4, under the conditions provided for in paragraph 10 of this Regulation; (c) plants and herbal preparations as defined in subparagraph c) of paragraph 4, under the conditions provided for in paragraph 11 of this Regulation; (d) other ingredients traditionally used in human nutrition or authorized in in accordance with the Sanitary Regulations for Novel Food or in accordance with this Regulation; and (d) food additives, flavors and auxiliary technological substances, authorized for use in human nutrition.
