Law No. 120 amending Law No. 1543- XIII on register of immovable property.

Law No. 1543- XIII on register of immovable property shall be supplemented with Article 55 (1) of the following wording: “Article 55 (1) The particulars of correcting errors made in the process of transferring ownership of land plots (1) Errors in supporting documents issued in the process of transferring ownership of land plots shall be classified as follows: (a) measurement errors - errors made at the stage of drawing up a topographic plan for the development of a land management project, or errors committed by cadastral work executors in determining the boundaries of land plots, which resulted in a graphical imposition of cadastral plans or the formation of free space between them and other inconsistencies in the configuration of the plan; (b) design errors - errors made at the stage of work on the development of the land management project (lack of registration of the direction of the rows of perennial plantations or incorrect drawing up of a list with the order of location of the owners of the projected land parcels); (c) identification errors - incorrect identification of real estate property and the holder of rights, as a result of which the data related to the owner in the land management project and/or in the document certifying the rights of the owner of the land plot do not correspond to the data in the identity documents; (d) discrepancies - differences between cadastral documentation and the requirements of existing normative acts (cadastral plans compiled in a conditional coordinate system, lack of graphic design of a land management project in electronic form, etc.). (2) The errors specified in paragraph (1) shall be corrected by the decision of the local council, issued in connection with a new land management project or a new geometric plan and, as the case may be, justifying the data related to the correct identification of real estate property and the holder of rights, if this correction does not lead to the transfer of ownership of the owners of land plots. The decision of the local council shall be the basis for updating the data in the cadastral plan and changing, as the case may be, the areas in the immovable property registry, as well as the identification data of the holders of rights entered in the real estate property register. The provisions of paragraphs (5) and (6) of Article 55 apply accordingly. (3) The correction of the errors indicated in paragraph (1) shall be financed from the state budget and/or from the assistance of development partners and shall be implemented in accordance with the program approved by the Government, in the order established thereby".
