Abstract
This Law establishes the legal basis for organizing, regulating and ensuring the effective and reliable operation of the energy sectors. The scope of this Law shall be as follows: (a) to create a legal framework for organizing and implementing activities in the energy sectors in terms of accessibility, continuous availability, reliability, continuity, competitiveness, quality and transparency; (b) establishing the basic conditions required to ensure the independence of the regulatory body; (c) regulation of legal relations among energy enterprises, between energy enterprises and consumers, users of the system, as well as between energy enterprises and central sectoral authorities, other central public administration authorities, regulators, other public bodies, and local public administration authorities; (d) creating the necessary conditions for limiting monopolistic activities, for liberalizing energy markets, and for developing competition in energy markets; (e) establishing basic principles for providing consumers with high-quality energy in fair, transparent and non-discriminatory conditions; and (f) creation of a legal framework for ensuring the country's energy security. This Law applies to: (a) the organization and functioning of the regulatory body, as well as the conditions for carrying out its activities; (a1) development of policy documents in the field of energy; (b) state energy supervision; (c) organization and implementation of activities in the energy sectors; (d) energy accounting; (e) safety and security of energy facilities; (e1) development of projects of common interest within Energy community, as well as projects of mutual interest; and (f) protection of consumer rights. Regulatory authority shall be appointed National Agency for Regulation in Energy Sector. Property in energy sector can be either public or private. Electric networks, natural gas networks, heating networks, as well as objects for storage and sale of petroleum products, regardless of the type of ownership, are subject to mandatory state registration in the Register of Engineering Infrastructure Facilities. The indicators of the production, export, import, transmission, distribution, storage, supply and/or trade of energy shall be measured by measuring equipment. This Law consists of VII Sections. Section I lays down general provisions. Section II attributes administrative competences to state energy supervision and state technical supervision in the field of industrial safety. Section III regards regulatory authority. Section IV regards organization and performance of activities in energy sector. Section V deals with registration of energy, statistical accountability and transparency. Section VI regards safety of the functioning of energy facilities and protection thereof. Section VII regards development and operation of energy infrastructure of strategic significance. Section VIII lays down final and transitional provisions.
