Law No. LP123/2025 “On the principle of mutual recognition of goods lawfully marketed in the Member States of the European Union”.

This Law aims to strengthen the development of trade between the European Union and the Republic of Moldova by applying the principle of mutual recognition and by eliminating unjustified obstacles to trade. It establishes national rules and procedures for the recognition of goods that comply with the provisions of the European Union act on the mutual recognition of goods in individual cases, relating to goods that are not subject to quantitative restrictions on imports and exports or measures having equivalent effect and that are lawfully marketed in a Member State of the European Union. This Law also provides for the establishment and maintenance of national product information points, cooperation and exchange of information in the context of the principle of mutual recognition. This Law shall apply to goods of any type, including agricultural and fishery products, as well as to administrative decisions, issued or to be issued by public administration authorities and/or by other institutions empowered by law to issue such decisions, in relation to any such goods which are lawfully marketed in a Member State of the European Union, where the administrative decision in question meets the following criteria: (a) the basis for issuing the administrative decision constitutes a national technical standard; and (b) the direct or indirect effect of the administrative decision consists in restricting or denying access to the market for goods. The declaration of mutual recognition shall be drawn up in accordance with the model provided for in the annex and must contain all the information specified in the annex.
