Abstract
The scope of this Law is to strengthen the legal and institutional framework in the field of organizing and conducting processes related to animal by-products or derivative products, not intended for human consumption, for the purpose of prevention and minimizing the risk of deterioration in public health and animal health posed by these products, and, in particular, for protecting food and feed safety chains. This Law establishes standards of public health and animal health concerning animal by-products and derivative products not intended for human consumption. It lists animal by-products that are not subject to the application of this Law. Animal by-products shall be intended whole carcasses or parts of carcasses of animals, animal products or other products obtained from animals not intended for human consumption, including eggs, embryos and seed material. Once operators produce animal by-products or derivative products subject to this Law, they identify these products and ensure that they are used in accordance with this Law (starting point). Operators ensure that at all stages of collection, transportation, circulation, processing, transformation, re-processing, storage, placing on the market, distribution, use and destruction within economic activities under their control of animal by-products and derivative products comply with the requirements established by this Law. Derivative products, which reached the processing stage, reached the end point in the processing chain, and at this point they are not the subject of this Law, in particular it regards cosmetic products for veterinary use and veterinary medicinal products. The aforesaid derivative products are subsequently introduced into the market without restrictions on the basis of this Law and are no longer the subject of official control carried out in accordance with this Law. Animal by-products are classified according to specific categories reflecting the level of risk to public health and animal health arising from the origin of animal by-products. The use of animal by-products and derived products for the following purposes is prohibited: (a) feeding terrestrial animals of certain species, with the exception of fur-bearing animals, with processed animal proteins obtained from carcasses or parts of carcasses of other animals of the same species; (b) feeding farm animals, other than fur-bearing animals, with catering waste or feed raw materials that contain catering waste or originating from such waste; (c) feeding farm animals with grass while grazing or grass cut from pasture treated with organic fertilizers or soil nutrients other than manure, unless grass cutting or grazing occurs after expiration of waiting period ensuring sufficient control of public health and animal health risks, which is at least 21 days; and (d) feeding farmed fish with processed animal proteins obtained from the carcasses or parts of the carcasses of other farmed fish of the same species. This Law contains IX Sections divided into 43 Articles. Section I lays down general provisions. Section II establishes powers of public authorities. Section III classifies animal by-products. Section IV establishes restrictions on the use and destruction of animal by-products and derivative products. Section V establishes the duties of operators. Section VI regards placing on market of animal by-products. Section VII regards import, export and transit. Section VIII establishes official control. Section IX lays down final and transitional provisions.
