Abstract
The purpose of this Law is to establish a general regulatory framework regarding the organization, regulation, ensuring the efficient functioning and monitoring of the electricity sector intended to supply consumers with electricity in conditions of accessibility, availability, reliability, continuity, quality and transparency, to provide adequate investment incentives for the production of electricity and the development of electricity networks, in particular to encourage long-term investments in a decarbonized and sustainable electricity system, as well as to contribute to the achievement of other objectives of the state policy in the field of energy. This Law aims to create an integrated electricity market that is competitive, consumer-oriented, flexible, fair and transparent. The Law establishes the fundamental principles for the efficient functioning of an integrated electricity market that ensures non-discriminatory access to the market for all resource providers and consumers, empowers consumers, ensures competitiveness and dispatchable consumption, energy storage and energy efficiency, facilitates the aggregation of distributed electricity demand and supply, and allows for sectoral integration and the integration of electricity produced from renewable sources into the electricity market, as well as its remuneration based on market mechanisms. In accordance with this Law, electrical energy is generated, transported, distributed, stored, supplied and consumed in the most efficient way. It establishes the competence of the Government, National Energy Regulatory Authority and local government in the field of electric energy. The following activities are carried out and regulated in the electricity sector: (a) electricity production; (b) energy storage; (c) operation of the electricity market; (d) electricity transmission; (e) centralized management of the electric power system; (f) distribution of electricity; (g) electricity trading; (h) electricity supply; and (i) aggregation. All the aforesaid activities shall be subject to mandatory licensing. The electrical energy generated, delivered, supplied and consumed is measured by measuring equipment. Final consumers have the right to be supplied with electricity by a supplier of their choice.
