Abstract
This Law applies to activities with narcotic substances, psychotropic substances, plants containing such substances, drug precursors, medicinal products containing narcotic substances, psychotropic substances and/or precursors, new psychoactive substances, drug substitutes and ethnobotanical products, carried out on the national territory for medical, scientific, industrial, expert, horticultural or other purposes permitted by law, as well as to activities for the prevention, control and monitoring of their circulation. Cultivation of plants containing narcotic or psychotropic substances shall be intended all work carried out on plants of species containing narcotic or psychotropic substances, including planting, planting, care (such as watering, weeding, fertilizer treatments and others), harvesting (including harvesting opium, coca leaves, cannabis or cannabis resin from producing plants), storage, use and processing thereof for the purpose of obtaining the respective substances. Horticultural purpose shall be intended the cultivation of plants containing narcotic or psychotropic substances for the purpose of obtaining stems, fibres, seeds, oil, biomass and other derivatives, which do not contain active substances in concentrations capable of producing psychoactive effects on the human body, without human end use for therapeutic, recreational or experimental purposes. The unauthorized cultivation of plants, provided for in tables IIII of annex no. 1., under national control is prohibited. The cultivation of plants under national control, such as the opium poppy or the coca bush, is permitted for industrial, scientific or horticultural purposes, based on the authorization issued by the Committee, according to the regulation approved by the Government and within the limits of the approved annual estimates. Distributors of plant seeds intended for cultivation deliver such seeds only to holders of the authorizations. The legal owner of agricultural land or land for other purposes is obliged to destroy plants under national control that grow spontaneously on the land in question.
