Abstract
This Order of the Minister of Environment the model standard contract for the use (management) of the national game fund. The Order mandates publication of the act on the Ministry’s website and assigns responsibility for monitoring implementation to a designated state secretary. The annexed contract template governs the legal relationship between the national administrator of the game fund and a legal person acting as manager of a specific hunting area. The contract defines the parties, legal basis, object and duration of the use right over a specified game fund unit, including its surface and boundaries, and establishes that the right of use is exclusive and non-transferable. It sets a 15 year term with possible extension under the Law, and provides for an annual fee for use of the game fund, payable directly to the State budget by 30 November each year, with procedures for verification of mutual accounts. Detailed obligations of the administrator include written information on regulatory measures, hunting periods, evaluation of game species, epizootic events, technical assistance, confidentiality of personal data, adjustment of the annual fee when productive hunting area changes, and annual approval of hunting quotas by species. The manager’s obligations cover compliance with all legal and contractual regulations on use of the game fund and hunting, keeping mandatory registers, issuing and recording hunting permits and tags, marking boundaries on the ground, guarding the game fund and combating poaching, conducting game population assessments, providing supplementary feeding and biotechnical works, avoiding damage to primary land uses and compensating third party damages, reporting periodically and annually to the administrator on disputes, game status and quota implementation, and acting against threats to game populations. The contract also sets out the manager’s rights (to hunt and utilize approved quotas, install hunting facilities with landowner consent, request fee adjustments, and seek early termination). It contains detailed clauses on suspension and unilateral termination (resolution) of the contract for non compliance, non payment, unjustified decline of key species, or false data, including time limits, liability for damages, and obligations to return the game fund and remove installations. Further provisions address force majeure (impediments beyond control), notification duties, dispute settlement (amicable or judicial under the national law), and formal requirements for amendments, number of originals, and notification of changes in party identification data.
