Abstract
This Law regulates the protection and management of national parks in general. As protected natural assets, national parks enjoy special protection. Nature protection regulations apply to national parks, unless otherwise specified by this Law. The national parks on the territory of Montenegro are: National Park "Biogradska Gora", National Park "Durmitor", "Lovćen" National Park, "Skadar Lake" National Park and "Prokletije" National Park. National parks are protected natural assets of category two (II). Protection, improvement and development of national parks is an activity of public interest. National parks are managed by a company with the status of a legal entity, which must meet the requirements for management of protected natural assets prescribed by the law regulating nature protection. The company is founded by the Government of Montenegro. The company manages all recognized national parks based on the management plan and annual management programs. The company will be engaged in the performance of the following activities relevant for the management of national parks: undertakes measures and activities to implement the established policy in management, use, protection, development and improvement of national parks; takes care of the implementation of the management plan and adopts the annual management program; implements protection measures in accordance with the protection regime; performs other tasks established by the law and its founding act.
The text is divided into nine main thematic Chapters and a total of 44 articles. Titles of these Chapters are as follows: I. General provisions; II. Borders; III. Protection, development and promotion measures; IV. Use of goods of national parks; V. Funds for work of the manager; VI. Access to information and public participation; VII. Supervision; VIII. Penalty measures; and IX. Transitional and final provisions.
The assets of national park such as land, forests, waters, flora and fauna and other natural resources, as well as work values created in national parks can be used in accordance with the law, the spatial plan of the special purpose and management plan, by taking into account the necessary preservation of biological and environmental diversity. Cultural, scientific-research, educational, tourist, recreational, sports and other activities in accordance with the law, which by their character, scope and method of implementation do not damage the natural values of national parks can be also performed. The protection, improvement and development of national parks is carried out on the basis of: special purpose spatial plan; management plan; annual management program. The special-purpose spatial plan defines protection zones with borders, conditions and protection measures. The management plan is adopted by the Government for a period of five years in accordance with the law. The management plan is drawn up by the company, with the previously obtained opinion of the Ministry. The annual management program is adopted by the company in accordance with the special purpose spatial plan and management plan, with the prior approval of the Ministry. Prohibitions are fully listed in article 16. Exceptions from prohibitions are defined in article 17. Ecosystem services are regulated in article 19; protection during the use of national park assets is defined in article 19; compensation fees are determined and classified in article 21; all forests present in national parks are defined as special purpose forests (article 24); management of land and other immovable property is defined in article 25; Restrictions on ownership rights are regulated in article 26.
