Abstract
This Law hereby defines the necessary conditions and procedures for the protection of plant varieties, as well as the rights and obligations of local breeder's.
This Law applies to all genera and species of plants on the territory of the Republic of Montenegro.
A single variety can be protected in accordance with this Law if it is new, distinct, uniform, stable and meets the conditions for granting the protected variety status.
The Law is divided into XI Chapters and 60 articles. Chapters are the following: Basic provisions (I); Variety protection (II); Methods for protection of variety (III); Rights and obligations of the breeder's right (IV); License (V); Termination of the breeder's right (VI); Costs (VII); Civil-legal protection (VIII); Inspection (IX); Penalty provisions (X); Transitional and final provisions (XI).
