Abstract
This Law establishes the basic principles of social and child/infant protection in terms of minimum social and health guarantees and human needs to be respected and considered of public interest in the Republic of Montenegro. This Law also sets the terms for the performance of social and child protection activities. Social and child protection is an activity that provides and implements measures and programmes intended for individuals and families with unfavorable personal or family circumstances, which include prevention, assistance in meeting of basic living needs and support of different types.
The text is divided into XVII main Chapters and a total of 178 articles. Titles of Chapters are as here listed: Basic provisions (I); Basic material benefits in social protection (II); Basic material benefits from child protection (III); Social and child protection services (IV); Jurisdiction and procedure for exercising rights from social and child protection (V); Social and child protection institutions (VI); Public institutions of social and child protection (VII); Other form of organization of service providers (VIII); Institute for Social and Child Protection (IX); Performance of work in social and child protection (X); License (XI); Programme accreditation (XII); Records and registers (XIII); Financing of social and child protection (XIV); Supervision (XV); Penal provisions (XVI); and Transitional and final provisions (XVII).
The realization of the public interest in social and child protection is provided by Montenegro and its local self-government, with a proclaimed goal that is the improvement of the quality of life and empowerment for independent and productive life of individuals and families. Rights under this Law may be exercised by a Montenegrin citizen residing on the state territory. Basic material benefits in social protection are: material security; personal disability allowance; allowance for care and assistance; health care; funeral expenses; one-time financial assistance; compensation to the parent or guardian of the beneficiary of the right to personal disability allowance. Basic material benefits from child protection are: compensation for a newborn child; child allowance; food costs in preschool institutions; assistance for the upbringing and education of children and youth with special educational needs; reimbursement of salary compensation and salary compensation for maternity or parental leave; compensation based on the birth of a child; refund of salary compensation and salary compensation for part-time work. The state may also provide other material benefits in social protection, in accordance with material possibilities. Article 46 regards the food costs in preschool institutions.
