Abstract
This Act lays down provisions on human rights and fundamental freedoms to guarantee gender equality and non-discrimination; general obligations of the Government and functions of the Minister to promote gender equality; administration and implementation of this Act; gender mainstreaming and gender responsive budgeting; enforcement of rights; and offences and penalties. This Act recognizes that gender discrimination is a violation of human rights, and all women are entitled to substantive equality in all areas of their lives, on an equal basis with men.
The purposes of this Act are to: (I) recognize, protect, promote, and enforce the full and equal enjoyment of all human rights and fundamental freedoms by all women and girls, on an equal basis with men and boys, thereby promoting gender equality and non-discrimination; (II) further implement the legal obligations of the Marshall Islands as a State Party to the Convention; and (III) adopt and implement a legal framework that: (a) establishes gender equality in the political, economic, social, domestic, and any other sphere, (b) incorporates the Convention into domestic policy and legislation, (c) recognizes and upholds all human rights and obligations related to women and girls in all their diversities under the Universal Declaration of Human Rights and other international human rights instruments, and (d) promotes gender mainstreaming in all sectors and at all levels.
The implementation of this Act aims at achieving the following strategic objectives: (i) enhanced and effective participation of women as equal partners in national and local development; (ii) gender inclusive and gender responsive development as part of a rights-based approach to development and poverty reduction; (iii) effective collaboration and coordination with development partners; (iv) improved gender statistics, including sex-disaggregated data, in all areas of women’s lives; and (v) effective mainstreaming of gender equality across all policies, planning, programming and budgets at all levels and in all sectors.
Section 717 underlines that the Government must ensure equal opportunities for women to participate and engage in the design, development, implementation, and monitoring of all activities relating to disaster risk management and climate change; the inclusion of a gender perspective in all policies, legislation, plans, programs and budgets; equal access of women to climate finance; equal opportunities for women to access training on climate change mitigation and adaptation; and equal participation of women in international climate dialogue and negotiations.

An Act to create a new Chapter under Title 26 of the MIRC to recognize, protect, promote and enforce the human rights and fundamental freedoms of all women and girls, on an equal basis with men and boys, and to further implement the legal obligations of the Marshall Islands as a State Party to the Convention on the Elimination of All Forms of Discrimination against Women; and to make related provisions.
