Abstract
The Act provides for the compulsory acquisition of private land by the State for public purposes. It regulates procedures of acquisition, compensation, vesting, etc.
The Act consists of 27 sections divided into 7 Parts: General Provisions (I); Preliminary Investigation and Declaration of Intended Acquisition (II); Proceedings in Court (III); Payment of Compensation (IV); Possession and Disposal (V); Divesting of Land (VI); General (VII).
Where the Minister decides that particular land or a servitude in any area should be acquired under this Act, he shall direct the Attorney-General to file an application in the High Court praying for a declaration by the High Court, that such taking of land for public use is lawful. In determining whether compensation for land rights is just, the High Court shall refer the matter to the Traditional Rights Court and shall give substantial weight to the opinion of the Traditional Rights Court.
