Abstract
This Act prohibits any person to import, manufacture, sell or distribute Styrofoam cups and plates, disposable plastic cups and plates, and plastic shopping bags, and promotes the importation, manufacturing, sale or distribution of recycled paper bags or reusable shopping bags. In case of violation of this prohibition, the person concerned shall be guilty of an offense and upon conviction liable for imprisonment or fine, or both.
Part III lays down provisions on container deposit, such as on the establishment of a Recycling Program to create a self-supported, safe and efficient system of disposal of beverage container throughout the Marshall Islands; payment of fees to the Authority for each deposit beverage container manufactured in or imported to the Republic; registration and record keeping requirements for deposit beverage distributors; and offences and penalties. The Environmental Protection Authority shall have the duty and authority to administer the Recycling Program. Part IV provides for the establishment of the Recycling Fund. The Environment Protection Authority shall promulgate the necessary regulations to ensure the proper administration and enforcement of the provisions of this Act.

Entry into force notes
This Act shall take effect on the date of certification and and shall apply on 1 February 2017.
