Abstract
This Law provides for protection to plant breeders of new plant varieties. It consists of 11 chapters: I. Title and Definition; II. Objectives; III. Formation of the Central Committee; IV. Duties and Powers of the Central Committee; V. Stipulations to recognize as a New Plant Variety; VI. Application of the Right of a New Plant Variety Protection; VII. Plant Breeder's Right; VIII. Nullity and Cancellation of a Plant Breeder’s Right; IX. Appeals; X. Offences and Penalties; and XI. Miscellaneous.
Chapter I contains the title and definitions. Chapter II lays down the objectives which include protection of the rights of plant breeders, developing plant breeding activity, and promoting local and foreign investment. Chapter III provides for formation and composition of the Central Committee for National New Plant Variety Protection. Chapter IV lays down the duties and powers of the Central Committee. Chapter V contains the conditions to recognize a new plant variety. Chapter VI provides for the procedure for application of grant of the breeder’s right in respect of a new plant variety. Chapter VII enumerates the rights of a plant breeder in respect of the protected variety and the cases in which such right shall not apply. Chapter VIII makes provisions for declaring a plant breeder's right as null and void. Chapter IX allows for appeals to the evaluation report of Technical Committee. Chapter X provides for offences and penalties.
