Procedures relating to the New Plant Variety Protection Law (Order No. 287/2021).

This Order has been issued in exercise of power conferred by subsection (b) of section 46 of the New Plant Variety Protection Law. Chapter I contains the title and definitions. Chapter II lays down the procedure for application for the right of new plant variety protection by a plant breeder. Chapter III provides for the right of priority and provisional protection. Chapter IV contains provisions in respect of inspection and monitoring of grower for propagation of a protected new plant variety including unauthorised use. Chapter V allows restriction of plant breeder’s right in cases of emergency situations such as natural disasters.
