Abstract
This Law provides for the establishment of Pesticide Registration Board, registration of pesticides and licensing of pesticides related activities in Myanmar. It consists of XVI chapters: I. Title and Definition; II. Formation of Registration Board; III. Duties and Powers of the Registration Board; IV. Application for Registration and Payment of Fees; V. Application for Licence and Payment of Fees; VI. Duties and Powers of the Chief Officer; VII. Duties and Powers of the Inspector; VIII. Duties and Powers of the Registrar; IX. Duties and Powers of Licence Holder for Formulating, Repacking and Selling Pesticide and Fumigation; X. Duties and Powers of the Licence Holder of Retail and Wholesale Pesticide; XI. Conditions for Compliance by Pesticide User; XII. Taking Action by the Administrative Means; XIII. Appeal; XIV. Prohibitions; XV. Offences and Penalties; and XVI. Miscellaneous.
Chapter I contains the title and definitions. Chapter II provides for formation of the Pesticide Registration Board (Board) and its composition. Chapter III lays down the duties and powers of the Board. Chapter IV contains the procedure to apply for import of pesticide or active ingredient. Chapter V provides the procedure for obtaining licence in respect of formulation and sale of pesticides, repacking and sale, providing pest control services, and for retail and wholesale pesticides. Chapter VI requires the Regional or State Chief Officer to inspect and supervise the subordinate officers in charge of the handling, use and storage of the pesticide. Chapter VII contains duties and powers of the Inspector.
Chapter VIII lays down the rights and obligations of a person who has the right to import or export pesticides or active ingredient. Chapter IX provides for the duties and powers of holders of licence to formulate, repack and fumigate pesticide. Chapter X contains the duties and obligations of a person holding a licence for retail and wholesale pesticide. Chapter XI lays down the conditions of pesticide use and requires compliance with instructions and guidelines. Chapter XI allows for action against licensee failing to comply with the conditions of the license. Chapter XIII provides for appeal from order passed under Chapter XI. Chapter XIV contains the activities prohibited and Chapter XV provides for penalties for violations.
