Abstract
These regulations, implementing the Fisheries Conservation and Management Act, amend the Aquaculture Operations Regulations (the principal regulations). I order to insert a new regulation 8, previous regulations 8 to 11 are renumbered as regulations 9 to 12. New regulations 8 provides for the power of the Director to order the release of live fish, held by or for a maritime aquaculture establishment in breach of the Act or of these regulations, into the sea. The new regulation further provides that when any legal provision of the European Union is to be given legal effect or be used in Malta such legal provision shall be deemed to be part of these regulations, including with regard to a possible order of release of live fish. The same will be valid also in relation to obligations,recommendations or objectives as found in a convention which Malta and/or the European Union have ratified and which Malta is obliged to implement under its jurisdiction in accordance with international law or European Union law.
