Abstract
An Act to make provision for the health of animals and in relation to this the health of human beings, and to regulate rights and duties of public bodies, legal entities and private persons veterinary activities.
The Act consists of 62 sections divided intro 11 Parts: Preliminary; Veterinary requirements (I); Requirements with regard to animal feeding stuffs (II); Requirements with regard to veterinary medicinal products (III); Zootechical requirements in connection with animal breeding (IV); Obligations of certain persons and other bodies (V); Professional veterinary activities (VI); State veterinary organization (VII); Functions and duties of National Veterinary Laboratory (VIII); Enforcement, offences and penalties (IX); Repeal (X).
Section 3 defines the application sphere of the Act. Sections 4 to 21 (Part I) provide for various measures to prevent or contain animal diseases, such as notification of diseases to trading partners of Malta (sect. 6), control on importation (16) and financial measures (18). They also define extensive regulation making powers of the Minister responsible for veterinary services for this purpose. Part II sets out basic rules for the (control of) production and marketing of feeding stuffs, whereas Part III concerns veterinary medicinal products, i.e. any medicinal product intended for animals. Part IV confers regulation-making powers on the Minister with respect to zootechical requirements in animal breeding. Part V defines the duties of owners, keepers, traders, importers, carriers, retailers, etc. of live animals, products of animal origin and products listed in the First Schedule, including animal reproduction and plant material. Section 36 concerns monitoring of animal waste and pathogens. Section 39 provides for the creation of Veterinary Surgeons Council, the functions of which is outlined in section 42. All State veterinary activities shall be under direction and control of the Department of Veterinary Services, which shall be headed by the Director of Veterinary Services. Section 50 provide for the creation of a National Veterinary Laboratory. Sections 51, 52 and 53 define the functions of the Laboratory.
