Abstract
This Act defines the rights of consumers of goods and services in Maldives, and aims to protect those rights. It also defines the responsibilities of sellers or providers of goods and sets the standards for the sale of goods and services. Chapter 2 lays down the conditions for sale of goods including the ownership and quality of goods being sold. The sale of defective goods is prohibited. The provisions in respect of price of goods and guarantee by manufacturers is also contained therein. Chapter 3 contains the rights of buyer of goods which includes right to return goods in certain cases, the right to test the goods being bought and the right to sue for damages. Chapter 4 provides for the conditions of sale of services and chapter 5 contains the rights of consumers buying services.
Chapter 6 lays down the responsibilities of sellers of goods and service providers. This includes non-discrimination, avoiding use of unfair business practices for marketing, negotiating or providing the goods or services. Further, provisions in respect of visibility of price, terms of service, labelling, expired goods and issuance of receipts are laid down. Chapter 7 provides for safety and other standards in respect of goods and services. The Minister may prohibit the sale of any good or service if it is found to be unsafe. The right to claim compensation and liability in dispute is provided for.
Chapter 8 lays down the unfair business practices such as untrue or misleading statements, misrepresentation, bait advertising and failure to give gifts or freebies after promising. Chapter 9 provides for unfair provisions contained in agreements, notices or other documents relating to sale of goods or services. Chapter 10 makes provisions for transactions carried out electronically. Chapter 11 lays down the powers and responsibilities of the Ministry with regards to price control, monitoring, inspection and recall of goods. Chapter 12 provides for appointment of Consumer Ombudsman and the procedure for filing complaints is laid down. Chapter 13 contains the offences and penalties.
