Abstract
These Regulations implement provisions of the Fertilizer Act of 2003 with respect to the Malawi Regulatory Service, the Malawi Fertilizer Advisory Committee, confidentiality and ownership of information regarding fertilizers, inspection, sampling and analysis of fertilizers, inspection fees, the Inspection Fund, the certificate of registration and labelling of fertilizers. The Regulations also prescribe offences and penalties, provide for measures of enforcement and contain special and final provisions.
The Regulations declare that the Malawi Regulatory Service (MFRS) shall be responsible for the enforcement and administration of provisions of the Act and Regulations made under it. The Malawi Fertilizer Advisory Committee (MFAC) shall advise the MFRS on technical matters. The Minister shall appoint inspectors and analysts for purposes of the Act. Importation or sale of fertilizer requires a certificate of registration issued by the MFRS. Fertilizers shall be labelled in accordance with these Regulations. Fertilizer shall meet the standards regarding plant nutritional value as set out in Schedule A to these Regulations. Inspectors may issue orders requiring a stop on sale of fertilizer violating any provision of the Act or Regulations made under it. The Regulations further require additional labelling of fertilizer containing substances deemed to be harmful for the growth of plants and sets out, in Schedule C, the maximum permitted heavy metal limits in fertilizers. The Regulations further concern guarantees on nutrient values and the promotion of nutrient management plans and environmentally friendly practices by farmers and the Government.
