Abstract
This Enactment makes provision for the conservation and protection of natural resources.
It is divided into the following Parts: Preliminary (I); Conservation and Improvement of Natural Resources (II); General (III).
For the purpose of this Act, the Director of State Department of Environmental Conservation may make orders for (a) the conservation of, or the prevention of injury to, natural resources; or (b) the protection and enhancement of the environment or the prevention and control of such activities which may cause pollution in a conservation area or any other land. Said orders may relate to any of the following: (a) the use of conservation areas, (b) the prohibition of certain activities, (c) the control of cultivation, (d) the preservation and protection of the source, course and banks of streams, (e) the protection and control of water, (f) the construction and maintenance of works for the conservation of natural resources, (g) the location or relocation of any agricultural, housing or industrial estates, farms, water catchment areas, places for fish or aquaculture in inland waters.
Any person undertaking any of the activities listed in section 5 may be required by the Director to submit a report describing the impact of such activities on the quality of the environment or the natural resources of the State.
General provisions concern inter alia the functions of Government departments, statutory bodies and local authorities, the granting of incentives, the powers of the Environmental Authority or any authorized officer, offences and penalties.
