Abstract
This Act aims to regulate international trade of wild animals and plants and to ensure Malaysia’s compliance towards the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) obligations.
The Ministry responsible for natural resources and environment shall be the Lead Management Authority for the purposes of this Act. Functions of the Lead Management Authority and of other authorities are set forth in the text.
The Act sets forth procedures and requirements for obtaining from the Management Authority: a permit to import or export any scheduled species; a certificate to re-export or introduce from the sea any scheduled species; and the registration to reproduce captive bred animals or artificially propagated plant or animal of any scheduled species for commercial trade purposes. Penalties for undergoing any of these activities without specific authorization are specified in the text.
The Act further provides for: powers of enforcement officers to investigate, search, seize and enter any premises, etc.; compounding of offences; regulation making powers of the Minister; etc.
