Abstract
These Rules consisting of 18 articles aim at regulating some powers of the Lembaga, the fisheries development Authority established in 1971. The Lembaga may declare any place or area as a fisheries complex or fisheries harbor where, without a permit, it is prohibited the following: (a) loading, unloading, keeping, collecting, processing, or dealing with any fish or any other types of dealing, (b) making any alteration, erecting any structure or placing any obstruction, (c) loitering, swimming, or fishing, (d) repairing or constructing any fishing net or fishing gear, (e) without written permission from the Director General, supplying fuel, ice, provisions, services, or conducting any business. The applications for permits shall be made in writing to the Director General.
As a general Rule, to deal with any fish within any fisheries complex, fisheries harbor, or fisheries landing jetty it is necessary to hold a valid license issued under the Fish Marketing Regulations 2010. Article 8 establishes that the declaration of private fisheries landing jetties needs the consent of the Lembaga, and they shall comply with any fish handling procedure (if the fish or fish products are intended for export they shall comply with the importing country’s requirements). Within any fisheries complex or fisheries harbor, charges are required for the following (i) holding a permit or entry pass for a vehicle; (ii) use of facilities or spaces; (iii) import, export, and transfer of fish; (iv) eventually, services provided by who operates a fisheries landing jetty.
The 2 Schedules define in detail fees for the permit to enter any fisheries complex or fisheries harbor (1), and different charges on vehicles (2).
