Abstract
The present Act provides for the setting up of the Palm Oil Registration and Licensing Authority, a body corporate engaged in the palm oil industry sector. The Act consists of the following Parts: (I) Preliminary; (II) Establishment, Duties and Powers of the Authority; (III) Finance, Report and Ministerial Supervision; (IV) Enforcement; (V) General.
The Authority shall exercise these functions: (a) to regulate, coordinate and promote all activities related to the supply, sale, purchase, distribution, movement, storage, export and import of oil pal products, and the milling of oil palm fruit; (b) to promote the efficient marketing and handling of oil palm products; (c) to collect information and maintain records of all relevant matters concerning the palm oil industry. Sections 12 defines the powers which are entrusted to the Authority. The latter is, inter alia, empowered to require the registration and licensing of persons in respect of any or all activities which fall within the scope of the competence of the Authority itself. The latter is also entitled to suspend or even cancel such licences. In order to finance the activities covered by the present Act, Section 15 provides for the establishment of a special Fund, to be administered by the Authority. The latter is required, under Section 21, to transmit every year to the Minister a report dealing with his activities and the policies. Part IV and V define the acts which constitute offences.
