Abstract
The Act consist of 35 Sections completed with 3 Schedules.
"Poison" means any substance specified by name in the first column of the Poisons List and includes any preparation, solution, compound, mixture or natural substance containing such substance, other than an exempted preparation or an article or preparation included for the time being in the Second Schedule. "Poisons List" means the Poisons List set out in the First Schedule as amended from time to time in accordance with section 6. The Third Schedule (Section 30) lists psychotropic substances.
The Act defines various substances as poisons, and addresses the importation, possesion, manufacture, compounding, storage, transport, sale, packaging, labelling and use of poisons. There shall be established an advisory board, the Poisons Board. No person other than a person licensed under this Act in that behalf shall import any poison from any place outside Malaysia. No person, whether licensed under this Act or not, shall knowingly sell, supply, keep or have in his possession or under his control or store any poison otherwise than in accordance with the regulations made under this Act and in force relating to the possession, containers, packaging, labelling or storing of such poison. No person shall transport or consign for transport any poison otherwise than in accordance with the regulations made under this Act.
