Abstract
The Act is divided into the following Parts: Preliminary (I); Administration (II); Licences (III); Wildlife Reserves and Sanctuaries (IV); General Exceptions and Presumptions (V); Offences and Penalties (VI); Miscellaneous (VII).
Initial provisions regard the appointment of officers, in charge of the proper implementation of the provisions of the Act. Section 29 concerns the issue of a licence permit or special permit (as the case may be) for the following activities: (a) to shoot kill or take any protected wild animal or protected wild birds, or take the nest or egg thereof; (b) to carry on business of a dealer; (c) to carry on the business of a taxidermist; (d) to house confine or breed a protected wild animal or a protected wild bird other than as a dealer or taxidermist: (e) to import into or export from West Malaysia any protected wild animal or protected wild bird; (f) to keep the trophy of any protected wild animal or protected wild bird; (g) to enter a wildlife sanctuary or a wildlife reserve. Further provisions of Part III concern the procedure to be followed for the issuance of the licence.
The Ruler or the Governor of a State may, after consultation with the Minister, declare any State land to be a wildlife reserve or sanctuary. Exceptions to the above-mentioned general rules are made in Part V, with particular reference to special permits, and to special purposes, such as: (a) destruction of grain-eating birds; (b) protection of crops; (c) protection against harmful or dangerous animals, etc. Final provisions concern offences and relevant penalties to be applied in case of contravention.
The Act is followed by nine Schedules: Totally Protected Wild Animals (1); Protected Wild Animals (2); Totally Protected Wild Birds (3); Protected Wild Birds (4); Protected Insects (5); Standard of Maturity (6); Poisons (7); Warrant to Search under the Protection of Wildlife Act, 1972 (8); Warrant of Arrest (9).
