Abstract

Section 2 contains definitions. There shall be a Department of Wildlife headed by a Director (sect. 3). The Director shall be generally responsible for the carrying into effect of the provisions of this Act and shall be assisted by Wildlife Officers. Specific duties of the Director are outlined in section 4. The Minister may propose areas of Sabah as Wildlife Sanctuaries to the Yang di-Pertua Negeri under section 9. Sections 10 to 20 prescribe procedures for the creation of Sanctuaries, provide for their management and place restrictions on hunting and other activities in those protected areas. Conservation Areas may be declared by the Yang di-Pertua Negeri under section 21. If there is an urgent need to save wildlife or its habitat the Minister mat declare provisional Wildlife Sanctuaries under section 22. No person shall hunt any animal specified in Part I of Schedule 1. Animals listed in Part I of Schedule 2 may be hunted only with a licence (sect. 25). Section 28 contains general provisions relating to hunting licences, whereas sections 29 to 32 provide for specific types of licences: sporting licence; commercial hunting licence; animal kampung licence, and other licences as may be prescribed. Section 33 places further restrictions on hunting. Section 54 places restrictions on the harvesting of protected plants listed in Schedules I and II. Section 56 provides for a plant collection licence. Sections 64 to 75 make provision for the creation of Wildlife hunting areas, for the management and conservation of such areas, and regulate procedures of expropriation and other matters related to creation of such areas.
