Decree No. 19/2007 approving the Regulation on Access to and Sharing of Benefits from Genetic Resources and Associated Traditional Knowledge.

This Decree approves the Regulation on Access to and Sharing of Benefits from Genetic Resources and Associated Traditional Knowledge. The purpose of this Regulation is to establish rules for access to the component of genetic resources, its protection, as well as the traditional knowledge associated with it and relevant to the conservation of biological diversity, sustainable use, including the fair and equitable sharing of benefits. It aims to regulate: a) Access to component of genetic resources existing in the national territory, on the continental shelf and in the EEZ for the purposes of scientific research, technological development or bio-prospecting; b) Access to traditional knowledge associated with genetic resources, relevant for the conservation of biological diversity, the integrity of natural resources and their components; c) The fair and equitable sharing of benefits derived from the exploitation of components of genetic resources and associated traditional knowledge; d) Access to technology for the conservation and use of biological diversity; Access to the component of genetic resources existing on the continental shelf will comply with the provisions of the Convention on the Law of the Sea and other applicable legislation for the exploitation of resources existing on the continental shelf.
