Abstract
This Government Notice is made under section 27 of the Environmental Management Act, 2007 by the Minister of Environment and Tourism and lists activities that may not be undertaken without an environmental clearance certificate. The list was drawn-up after following the consultative process referred to in section 44 of that Act. The Notice also stipulates that, if no person or authority is in terms of any law charged with the responsibility of granting authorization in respect of an activity listed in this Notice, the Minister is the competent authority in respect of the activity, unless otherwise determined in terms of section 30(3) of the Act. Activities include: waste management, treatment, handling and disposal activities, mining and quarrying activities, clearance of forest areas, deforestation, afforestation, timber harvesting or any other related activity that requires authorisation in term of the Forest Act, 2001 or any other Law, land use and development activities, agriculture and aquaculture activities, water resource developments and handling of hazardous substances.
