Abstract
This Act makes provision for the protection of the environment and contains measures to ensure sustainable development in Namibia.
Principles of environmental management stated by this Act include: promotion of community involvement in natural resources management and the sharing of benefits arising from the use of the resources; (b) promotion of participation of all interested and affected parties and taking into account the interest, needs and values of interested and affected parties; (c) promotion of equitable access to environmental resources and taking into account of the functional integrity of ecological systems to ensure the sustainability of the systems and to prevent harmful effects; (d) protection of Namibia’s cultural and natural heritage including, its biological diversity for the benefit of present and future generations.
The Act defines functions of the Minister and establishes the Sustainable Development Advisory Council. The Minister shall appoint an Environmental Commissioner, who must perform the functions set out in this Act subject to the general or specific policy directives of the Minister. In addition, the Act defines powers of enforcement of environmental officers.
The Act further defines offences and makes provision for: environmental plans, environment impact assessment, appeals and regulation-making powers of the Minister.
