Abstract
This Act provides for rights and claims relative to mining operations in Namibia, the establishment of Minerals Board of Namibia, the administration of the Act, and for other matters relative to mining such as financial matters, the sale and export of minerals, the protection of the environment, environmental impact assessment and the liability of holders of licences or mining claims for pollution of environment or other damage caused.
No person shall carry on any reconnaissance operations, prospecting operations or mining operations in, on or under any land in Namibia, except under and in accordance with a non-exclusive prospecting licence, a mining claim or a mineral licence, as the case may be (sect. 3). The Minister shall appoint a Mining Commissioner under section 4. The functions of the Minerals Board of Namibia, established under section 10, shall be to advise the Minister. Sections 16 to 24 regulate application for and granting of non-exclusive mining prospecting licences. Sections 25 to 30 concern the pegging of claims. Section 31 and following define the rights of holders of mining claims and regulate the registration, etc. of claims. The Minister may, with due regard to good reconnaissance practices, good prospecting practices or good mining practices by notice in writing, give directions in relation to the environment and other matters to a holder of a mining licence (sect. 57). Sections 58 and following regulate reconnaissance licences. (140 sections divided into 17 Parts and completed by 2 Schedules)
