Abstract
This Act establishes the Tobacco Products Control Committee and provides for its constitution and administration. The Committee is to carry on the following functions, including; (a) to make recommendations to the Minister in relation to the application of this Act, any amendment to this Act and the making of regulations; (b) to advise the Minister on the duties and functions to be performed in terms of this Act and on matters referred to the Committee by the Minister; (c) to inquire into, and advise the Minister on, matters relating to the control of tobacco products in Namibia;(d) to carry out research into matters referred to the Committee by the Minister; (e) to advise the Minister and the Permanent Secretary on the administration of the Fund; (f) either on its own initiative, or at the request of the Minister, to consult with the Minister on any matter relating to the control of tobacco products in Namibia; (g) to develop comprehensive public awareness programmes on the health dangers and negative economic and environmental outcomes of the use of tobacco products. The Act makes certain prohibitions against the advertising, sponsorship and promotion of tobacco/tobacco products, and mandates that the packaging of tobacco products must be labelled in a manner that shall bear the warning concerning the health hazards incidental to the smoking of tobacco products. There are also provisions to reduce the supply of tobacco products, for instance measures to prevent the illicit trade in tobacco products, the prohibition of sale of tobacco products to persons under the age of 18 years, prohibition of free distribution and reward of tobacco products, etc.
