Agreement
Abstract
The purpose of this Agreement is to create conditions allowing the Parties to cooperate on issues of prevention, detection and suppression of production and sale of goods with false trademarks and geographical indications, as well as the movement of such goods through government borders of member states of the Commonwealth of Independent States. The Parties in accordance with the legislation of the states participating in this Agreements take concerted measures to prevent and suppress production and sale of goods with false trademarks and geographical indications based on joint actions and voluntarily adopted thereby obligations. Procedures to ensure compliance with trademark and geographical indications rights must be equal and fair for all Parties. The Parties, recognizing the need to implement joint measures to protect consumers and manufacturers from selling goods illegally marked with designations identical or confusingly similar to protected trademarks and geographical indications, in order to coordinate actions to prevent and suppress the use of such misleading designations, as well as other acts of unfair competition have agreed as follows: (a) geographical indication shall be intended a designation, the rights to which arose in accordance with the legislation of the states parties to this Agreement and which identifies the product as originating from the territories of the participating states of this Agreement, a region or locality in these territories, if the quality, reputation or other characteristics of the goods are largely due to its geographical origin. The Parties acknowledge that geographical indications may be protected as appellations of origin of goods in accordance with legislation of the states parties to this Agreement; and (b) false geographical indication shall be intended a designation applied to a product, which violates the rights of the copyright holders of the relevant geographical indications and (or) is capable of misleading consumers regarding the quality, origin or other characteristics of the product.
