Abstract
This Act provides for basic rules and principles as regards the domestic and wild animals and their necessary health, protection and welfare issues.
This Act has the direct purpose to transpose into the Legal system of Gibraltar the provisions of Council Directive 92/65/EEC of 13 July 1992 laying down animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A (I) to Directive 90/425/EEC; Regulation (EC) No 998/2003 of the European Parliament and of the Council of 26 May 2003 on the animal health requirements applicable to the non-commercial movement of pet animals and amending Council Directive 92/65/EEC; and Commission Regulation (EC) No 592/2004 of 30 March 2004 amending Regulation (EC) No 998/2003 of the European Parliament and of the Council as regards the lists of countries and territories.
The Act is divided into VI main Parts and 27 sub-sections. Titles of main Parts are as follows: Introductory (I); Diseases of animals (II); Protection of animals (III); Legal proceedings (IV); Penalties (V); Animals in distress (V-A); Miscellaneous provisions (VI).
Main topics regulated by this Act are as follows: importing or keeping of diseased animals; diseases notifications; cruelty to animals; abandoning animals; export of horses; registration, licensing and vaccination of dogs; microchips; injuries by animals to persons or property; protection of cetacean; dangerous animals; damage to animals; destruction and deprivation of ownership; power to disqualify persons convicted of cruelty to animals; power and duties of authorized officers and others; various penalties.
