Abstract
This Act sets the principles aimed at imposing the control over the import into, export from, and sale in Gibraltar of endangered animal and plant species.
This Act further has the purpose to transpose into the Legal system of Gibraltar the provisions Council Regulation (EC) No 338/97 of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein; and Commission Regulation (EC) No 939/97 of 26 May 1997 laying down detailed rules concerning the implementation of Council Regulation (EC) No 338/97 on the protection of species of wild fauna and flora by regulating trade therein.
The text is divided into 9 sections (Title and commencement; Restriction on the importation and exportation of certain animals and plants; Prohibition on sales, etc; Scientific authorities; Amendment and interpretation of Schedules; Restriction of movement of certain live animals after importation; Offences by corporations; Regulations; Repeal).
Schedules 1-4 are also part of this publication (list of animals etc., for which the importation, exportation and sale are restricted; list of plant species for which the importation, exportation and sale are restricted; list of other related items for which the importation and exportation are restricted; and guidelines for the interpretation of Schedules 1 and 2).
