Abstract
The purpose of this Act is also to give effect in the law of Gibraltar to Council Directive 96/59/EC on the disposal of polychlorinated biphenyls and polychlorinated terphenyls. (European Union legislation here directly involved: Council Directive 75/442/EEC of 15 July 1975 on waste; and Council Directive 96/59/EC of 16 September 1996 on the disposal of polychlorinated biphenyls and polychlorinated terphenyls).
The Act is divided into 13 sections. Main topics covered are: title and commencement; interpretation; prohibition on holding without registration; prohibition on holding irrespective of registration; labelling of contaminated equipment; registration; cancellation of registration or particulars; inventory of contaminated equipment; information for the inventory; information for the public; offences and penalties; regulations; amendment of the Public health Act.
Schedules 1-2 are also part of this publication (containing the list of disposal operations D8, D9, D10, D12 and D15 as set out in Annex IIA of Directive 75/442/EEC on waste, as amended; and guidelines and indication marks as regards the labelling of decontaminated equipment).
