Abstract
These Regulations, in exercise of the powers conferred on it by section 118 of the Gibraltar Merchant Shipping (Safety, etc.) Act, 1993 and all other enabling powers, the Government, for the purposes of implementing in Gibraltar Regulation (EC) No 782/2003 of the European and of the Council of 14th April 2003 on the prohibition of organotin compounds on ships as amended and provided for by Commission Regulation (EC) No 536/2008 of 13 June 2008, and the International Convention on the Control of Harmful Anti-fouling Systems on ships, 2001, here establish the provisions as regards the necessary vessel/ship anti-fouling system certifications and related administrative proceedings.
The text is divided into 17 Regulations, as follows: Title and commencement; Interpretation; Application of these Regulations; Surveys and certification; Bar to putting a ship into service for the first time, etc; Requirement for carrying on board the ship an AFS-Declaration; Arbitration; Cancellation of a certificate; Availability of certificates and other documents; General provisions on inspection of ships; Inspection of ships following a Government request; General provisions on detention; Appeals; Offences and penalties; Offences committed due to the act or default of another person; Offences by body corporate; Defences.
Schedules 1 and 2 are also part of this text (Forms of the certificate and record for anti-fouling systems; Declaration on anti-fouling system for ships of 24 meters or more in length, but less than 400 gross tonnage).
