Abstract
This Act provides for regulation of handling and disposal of non-biodegradable material in Jammu and Kashmir. Chapter II makes provision for constitution of the prescribed authority and lays down the powers and functions it must exercise and perform. Chapter III gives power to the government to declare, after consultation with the prescribed authority, any area to be non-biodegradable material control area for the purposes of the Act. It can ban, prohibit or restrict the use of non-biodegradable material in such areas. The Act prohibits disposal of non-biodegradable material or garbage in any drain, ventilation, shaft, pipe and fittings, connected with private or public drainage works, natural or man-made lakes and wetlands. Chapter IV lays down the penalties and gives power to the government to make rules to carry out the purposes of the Act.
