Abstract
This Act provides for prevention and eradication of plant diseases, pests, parasites and weeds. Under Section 3, if it appears that any disease, pest, parasite or weed in any area is injurious to plants, or is likely to contaminate water supply or obstruct waterways, and that it is necessary to take measures to eradicate or to prevent its introduction, spread or reappearance, the Government may, declare the area to be an affected area. Section 4 allows the district magistrate to take appropriate measures in the affected area notified under section 3. Section 5 lays down the duties of occupier including taking measures directed under section 4. Sections 6 and 7 provide for the powers of inspecting officers including entering any land, water or premises and carrying out measures as required. Section 8 lays down the power of the government to undertake emergency measures. The Act also provides for appeal, penalties in case of contravention, appointment of inspecting officers and other related matters.
