Abstract
This Act provides for the conservation and management of wild species, wild flora and habitats in the Jammu and Kashmir State.
The Government may, for the purpose of this Act, appoint a Chief Wildlife Warden and other wildlife wardens. The Government shall constitute a State Board for Wildlife to: advise the Government in the selection and management of the areas to be declared as protected areas and in the formulation of the policy for the protection and conservation of wildlife and specified plants; and to carry out impact assessment of various developmental projects on Wildlife or its habitat and review the progress in the field of wildlife conservation in the State.
The Act prohibits the hunting of any wild animal specified in Schedules I-IV unless in certain cases and in possession of a permit granted by the Chief Wildlife Warden.
Picking, uprooting, damaging, collecting, etc. specified plants shall be prohibited unless in possession of a permit granted by the Government as provided for in the text. Cultivation of specified plants shall also be prohibited without a licence.
The Government may, by notification, declare its intention to constitute any area comprised within or outside any demarcated or undemarcated forest as a sanctuary if it considers that such area is of adequate ecological, faunal, floral, geomorphologic or natural, for the purpose of protecting, propagating or developing wildlife or its environment. The Act provides for proceedings to acquire rights in land for conservation purposes. The Government shall constitute an advisory Committee for each sanctuary. The Act also provides for the declaration of National Parks and Conservation Reserves.
The Act further provides for: management and recognition of zoos and deer parks; trade and commerce in wild animals, animal articles and trophies; prohibition of dealing in trophies, animal articles etc. derived from specified scheduled animals; prevention and detection of offences; etc.

Notes
As from the commencement of this Act, the Jammu and Kashmir Game Preservation Act, 1998 relating to any matter contained in this Act shall, to the extent to which that Act or any provision contained therein corresponds, or is repugnant to this Act or any provision contained in this Act, stand repealed.
