Abstract
This Regional Legislative Decree, consisting of 23 articles adapts to the Autonomous Region of Madeira Decree-Law no. 39/2008 establishing the legal regime for exploitation and functioning of touristic infrastructure. The adaptations introduced by this Legislative Decree applies to all tourism enterprises and local accommodation establishments that are located and carry out their activity in the Autonomous Region of Madeira. The competences of the regime in adaptation to 'Turismo de Portugal, IP', its president and the Food and Economic Security Authority are carried out within the Autonomous Region of Madeira by the Regional Directorate for Tourism in relation to all tourism enterprises. The establishment of the maximum capacity of accommodation including within rural areas referred to in Article 18 (3) (a) and (b) of the diploma in adaptation is also a responsibility of the Regional Directorate for Tourism. The responsibilities attributed to the Institute of Nature Conservation and Biodiversity, I. P., are exercised, in the Autonomous Region of Madeira, by the government department responsible for the environment.
