Abstract
This Law, consisting of 101 sections and divided into twelve Parts, provides for adequate potable water and water supply in Ekiti State. The Law establishes agencies, associations and committees for water service delivery. According to the Law, the State Government provides for management and maintenance of the water supply scheme, the Ministry identifies and marks all the urban areas in order to provide for water supply. The Water Consumer Association is responsible for potable water supply in small towns and rural areas, for management of all water supply services, water service assets and for the promotion of rationale use of water resources and for its protection from pollution and other nuisance. The Law defines general powers of the Association, including: determination of fees; preparation of developmental plans for the maintenance and development of water supply services assets; acquisition, purchasing, construction, maintenance of any property forming part of the water services assets; undertaking any land acquisition procedure necessary for the performance of its functions; procuring water abstraction rights from the relevant authorities; abstracting water from any lake, river, stream or other natural source forming part of the water resources of the State; examination of any surface or underground water for determining any eventual pollution; entering upon any land or into premises for inspection activities.
Other matters covered by this Law regard: establishment and functions of water service providers; conditions for the provisions of water service providers; duty to provide access to prescribe water services; rights and obligations of water service providers; role of State Government; private sector participation; local government authorities; establishment of Ekiti State Water Supply Regulatory Agency and definition of its power, objectives and functions; standards and tariffs; funds of the Agency; reports, accounts and audit; establishment of State information system; content of water services development plan and implementation; private sector participation agreements; water sanitation and hygiene; responsibility of the Ministry of environment in reducing water pollution; pollution prevention; fouling water; offences and penalties, including: illegal construction of waterworks, offences related to water diversion, pollution, wastage, nuisance, adulteration and fraud; miscellaneous and transitional provisions; definition of relevant terms, including: water abstraction; basic water supply; consumer; hygiene; owner; pollution; potable water; private sector participant; property; sanitation; waterworks; water service provider; water quality standard.
